Per the Statute of Frauds, promises in consideration of marriage need to be reduced to writing in order to be enforceable. As such, is an engagement ring a promise in consideration of marriage, or is it a gift? If it's a promise in consideration of marriage, does the engagement ring return to the person who gave it if there is no written contract and the engagement falls apart? Please explain.
