Perry paid $1,500 to watch a regional football tournament which featured some internationally renowned players. Unfortunately, because of adverse weather conditions, only nine minutes was played and the remainder of the tournament, which was being held in Hong Kong Stadium, was cancelled. Perry wrote to the Leisure and Cultural Services Department, the local authority, requesting a refund but was informed that he would not be entitled to a refund because he had seen some play. When he complained further, Perry was told it was the standard policy in all regional Football Association tournaments and the information about the conditions for refund was contained in the booking form and literature delivered with the tickets.
