Planned Parenthood vs. Casey

(1) As a judge selected to decide on the following supreme court case "Planned Parenthood vs. Casey" I would take precedent into consideration because it is such an essential concept in law-making. Justice has been made by looking at prior cases and resulted in reasonable decisions. However, rulings shouldn't be based solely on precedent because there may be times when it's good to get rid of old laws to create better ones. In this case, I'd most likely make a new rule but I'd take into consideration previous cases to make a reasonable decision. This new rule will not allow the state to interfere with a women's decision in an abortion. Under this current law, states have created restrictions that have made it difficult for women to get an abortion. This new rule will not allow the State to perform a viability analysis in a women's first trimester that if viable, the state can prohibit the abortion. However, I agree that minors should have a parent's consent to proceed with this procedure.

Overall, women have the right to make their own decisions and maintain privacy about those decisions without having the state interfering.

(2) As a judge who is selected to decide "Planned Parenthood v. Casey," I will not follow precedent; rather, I will make a new rule, which would favor Casey. There should be some protection for the unborn fetus. I do understand that some circumstances might necessitate the abortion of the fetus. For instance, if the mother's health and the fetus are in danger, it should be acceptable to abort the fetus. In addition, if the woman becomes pregnant by rape and does not want to keep the fetus, there should be some flexibility. We cannot force a woman to keep a fetus that is conceived without her will. I do believe that the woman has the right to decide what is good and bad for her life. Nevertheless, putting some restrictions regarding abortion is the right decision to do it. According to Casey, women must give informed consent, receive state-published information, minors under eighteen years old, a parent must give informed consent, married women must notify their husband, and providers must keep records and report information. However, I will replace the 24 hours wait to get an abortion done to ten days. Making the woman wait longer will give the woman enough time to make the right decision. Sometimes, a woman decides to abort without thinking about it enough and regrets her action after doing it. Keeping the rules in Casey and making the change that I suggested will help the woman make the right decision and help the unborn fetus.
