For three years, he subleased the building to a business that operated a bar on the premises. In 2003, the subtenant moved and Dale made an oral agreement with Frances for operation of the bar. Frances agreed to manage the bar by purchasing sup- plies, paying bills, keeping the records, and hiring and firing employees. Frances and Dale agreed that each would receive $200 per week plus one-half of the profits. Frances agreed to provide a monthly account- ing to Dale. Dale claims that he owns the business and Frances is an employee. Frances believes she and Dale are partners. Are Frances and Dale partners? Explain. (b) Elwood, a bachelor, inherited a farm from his father in 1980. Soon thereafter, he and his sister Nora moved into the farmhouse and began farming operations. Elwood raised the crops and livestock while Nora handled the cooking and housework and kept the books. A sign on the land read "The Elwood and Nora Farms." Elwood and Nora discussed all major pur- chases such as equipment and livestock. Nora wrote all checks but the checks were drawn on account solely in Elwood's name. All property was registered in Elwood's name. Elwood annually filed an individ ual tax return and Nora filed no tax returns. All profits were reinvested in the farming operation.
