X 46. Jacques is an amateur tightrope walker (or funambulist) and his agent has booked him a tightrope-walking gig across the Grand Canyon. Jacques does not feel that he can possibly perform this feat and is thinking of telling his agent to cancel it. But then, one night, while watching television, he sees an ad for Power Balance bracelets. The ad claims that the bracelets use holographic technology to resonate with and respond to the natural energy field of the body, increasing sporting ability, strength, a rength, agility, and balance. Jacques picks up the phone and orders twelve at a cost of $30 each. With the additional help the bracelets will provide, he feels confident in his ability and tells his agent the gig is a go! On the day of the big tightrope walk, Jacques is wearing all twelve of the Power Balance Bracelets but, despite his expectation that they will improve his skills to herculean levels, he almost immediately falls . He is saved by the safety harness, but there is no safety harness for his career or his pride. Jacques wants to sue the makers of Power Balance bracelets, but for what should he sue them? a. Unilateral Mistake b. Fraudulent Misrepresentation c. Strict Liability d. Breach of ContractX The bell rings to the front door of Miracle Max's shop and, when he answers the door, he finds Inigo, Fezzik, and the limp, lifeless form of Westley, who has recently died in a disastrous hydraulic suction machine mishap. Inigo and Fezzik ask Max if he can do anything to bring Westley back to life, because Westley owes them both money from a card game the previous night. Max examines Westley's body and knows he can do nothing for him. (He was, after all, fired by the king's stinking son specifically because his miracles were of such poor caliber). But, because times are tough and the bills are piling up, Max tells Inigo and Fezzik that, for all the money they currently have, he will make them a 'Miracle Pill' that will bring Westley back from the dead (or back from the mostly dead, anyway), provided they wait half an hour for full potency. Overjoyed, Inigo and Fezzik empty their pockets and Max prepares the pill. The men leave and Max has a good laugh at their gullibility. When, half an hour later, Inigo and Fezzik shove the 1 1 10 1III miracle pill down Westley's throat, nothing - of course - happens. There are no such things as miracles and Westley stays dead. Inigo and Fezzik call up their lawyers, Humperdink and Humperdink and initiate a lawsuit against Max for breach of contract, but will they win? a. No, if their reliance on Max's representations was unjustified b. Yes, if Max's offer was a bilateral one c. No, because they were not harmed, Westley remained as dead as he already was d. Yes, if they can prove promissory estoppel 2. What is the burden of proof that a plaintiff must meet in a civil trial in order to prevail? a. Preponderance of the Evidence b. Clear and Convincing Evidence c. Beyond a Reasonable Doubt d. Probable Cause NX 6 . Bran, the third-oldest child of Ned and Catelyn Stark, conveyed Winterfell to his sister Sansa via a quitclaim deed for $1.00 based on his assumption that, though he did not at the time own Winterfell, he would eventually acquire it when his parents and older siblings died (Bran believes he can see the future, though he does not appear to make any beneficial use of this power, instead mostly getting crossfaded in an old hollow tree with some granola types he met on a camping trip or just general acting like a creep). Sansa does not know much about property law and doesn't understand whether or not Bran's quitclaim deed is valid at that time but she is willing to take a chance for such a low price. Later on, Bran did, in fact, become the owner of Winterfell in fee simple absolute by action of the intestate death of his older brother Robb who had inherited after the death of Ned. After Bran's ownership of Winterfell became official, Sansa demanded that Bran provide her with a warranty deed to reflect that Sansa's title as owner was now absolute. Leaving aside whether Sansa could sue Bran for fraud based on the initial quitclaim deed transfer, what is the nature of Sansa's interest in the property at the time that she demanded the warranty deed of Bran? a. Sansa, now that Bran acquired ownership from Robb, is accordingly, due to the earlier transfer of the quitclaim deed from Bran to her, the owner of Winterfell in fee simple. b . Sansa, since she possesses the quitclaim deed from Bran but Bran received fee simple ownership of Winterfell from Robb's estate, acquires one half ownership of Winterfell along with Bran in the form of a tenancy in common. C. Sansa owns nothing because, at the time Bran issued her the quitclaim deed, Bran owned nothing and therefore nothing was conveyed. d. Sansa takes ownership of Winterfell in the form of a life estate, but upon Sansa's death, Bran or Bran's heirs will have superior interest in the title as owners of a vested remainder interest. has been transferred, but NOT 7. In a Bailor/Bailee relationship, a. Money, Consideration b. Possession, Title c. Ownership, Control d. Use, Liability A
