QUESTION 3 Section 13 of Atomic Energy Act 2016 provides that: (1} The Minister may, for the purpose of carrying out the provisions of this Act, make regulations, including regulations a) for regulating the production, import, export, transport, rening, possession, ownership, sale or disposal of or other dealing in any radioactive material, nuclear material, prescribed substance, irradiating apparatus or any other thing that in the opinion of the Minister may be used for the production, use or application of atomic energy. Further, Section 31 of the same legislation provides: (1} The Council may, with the approval ofthe Minister, make regulations regarding a) making provision to secure that any radioactive product or radioactive waste from any source whatsoever is accumulated or disposed of safely; b) prescribing the method of treatment or disposal of any conveyance, package or container that has been used to carry, hold or store any radioactive material, nuclear material, prescribed substance, irradiating apparatus or radioactive waste. Based on power conferred on the Minister of Science, Technology and Innovation via Section 13 and Section 31 of the Act, the Minister has enacted two subsidiary legislations namely Atomic Energy (Administration) Regulations 2018 and Atomic Energy (Basic Safety Radiation Protection} Regulations 2017, respectively.
