3. In the morning of 17 March 2021 (Wednesday), Mr Cheng was caught littering in public places by the police in Lai Chi Kok. At the evening of 17 March 2021, he heard from the television news that the Legislative Council just passed a new Littering Ordinance, which doubles the fine for littering. Mr Cheng has no previous conviction for littering, but he does not admit his littering offence. Mr Cheng is the cousin of the Chief Executive of HKSAR, Ms. Carrie Lam. REQUIRED: (a) Will Mr Cheng be sued for littering and will he be brought before 10% the court? If so, to which court will he be brought? (b) Advise Mr Cheng whether he will be required to pay the double 10% fine under the new law. (c) The police advised Mr Cheng that this is just a trivial matter and 5% he is not allowed to instruct a lawyer to represent him before the court. Is it correct? Please explain your answer.
