Drakehouse Ltd Incident 1

Drakehouse Ltd has recently been granted planning approval for five high-end residential developments in Bayswater. The application was previously rejected and it went to appeal. Two weeks before the appeal committee granted approval, several members of the committee were invited to, and attended, a lavish champagne reception hosted by Drakehouse Ltd to celebrate the opening of its new office in Dubai. Several local newspapers have reported the fact that the committee members attended and that planning approval was later granted, despite objections by local residents. The committee members were invited by Charlene Du Bois, lead architect on the Bayswater project and Andr's wife.

Incident 2

Drakehouse's Dubai office has recently obtained planning permission to build a skyscraper in Shajah. In order to obtain planning permission, the Dubai office promised to pay the Minister of the Ministry of Planning 100,000, which will be used to build several new roads and hospitals in the area. The Dubai office insists that this is standard procedure.

Incident 3

It has emerged that Charlene Du Bois has signed off final certificates on a number of projects before the work has been fully completed. The final certificates allow contractors to request payment from the client. In addition, several payments have been made by the contractors to Charlene Du Bois's personal account. She insists that this is payment for freelance work and is not related to the final certificates, which she claims were signed off in error.

1.1 Content

(1) Under the heading "Introduction", the report must include an explanation of the two purposes of the report.

(2) Under the heading "Findings", the report must answer the following four questions (a) - (d). Your answer to each question must identify, describe and apply the relevant section(s) of the Act.

(a) In Incident 1, has Charlene committed an act of bribery within the meaning of the Act?

(b) Could Drakehouse Ltd be liable for Charlene's actions in Incident 1?

(c) Could the Dubai office in Incident 2 be prosecuted for promising money to the Minister of the Ministry of Planning in Shajah in return for planning permission?

(d) Has Charlene committed an offence in Incident 3?

(3) Under the heading "Conclusion", you must:

include an appropriate closing statement to summarise your findings;

state any possible penalties under the Act which may be applied to Charlene, Drakehouse Ltd and the Dubai office.
