I believe that there are certain forms of discriminatory hiring which is impossible to avoid, "The anti-discrimination laws are not absolute. Some jobs may call for an individual of a particular gender or religion. You would not want to hire a man as an attendant in a women's locker room, for example. The laws are complex regarding what is and is not acceptable in this regard. Just because a business manager has a strong adherence to one religion, for example, does not necessarily justify hiring only applicants from the same religion," (Sarokin, D. (2019)). A candidate, in order to avoid being a victim of these practices, must avoid making statements which are are supporting towards a particular ideology or belief. The answers to the questions must be to the point and only relevant to the the job for which it is applied. Any question which has a sense of discrimination must be avoided in totality and a balanced approach must be used in answering such questions if it is mandatory to answer such questions.

If I were managing, there are a couple steps I'd implement to avoid involuntarily discriminating:

  1. "A detailed, well-written job description is an important document in any defense against possible discrimination complaints. It serves to objectively outline the responsibilities, duties, and specific requirements for the position and can guide you in conducting fair assessments of job applicants," (SCORE, n.d.).
  2. Use a legally sound job application. This essentially encourages employers to pose questions that aren't personal/private information (or could be seen as discriminatory). For example, asking what year the candidate graduated high school can allow employers to determine age without being as forthright.
  3. Ask consistent interview questions based on the job description. "You can conduct solid interviews by asking each candidate the same questions -- and ensuring that these questions relate directly to the responsibilities, duties, and requirements of the position. Probing each candidate based on the answers they provide is okay, but straying from the job description and subjecting just one candidate to a line of questioning that is different from the others can invite unwanted legal issues," (SCORE, n.d.)
  4. Minimize small talk during interviews. Off topic conversations can lead to involuntary discrimination. Keeping all small talk or unrelated conversation to a minimum avoids this situation.
  5. Train everyone involved in the hiring process. Having everyone understand and work the same way avoids any discrimination. This ensures everyone is on the same page, understands/acknowledges the risks, and follows through their part of the hiring process the same.
