He has called the police and everyone else who will listen but no one seems to be able to stop it. As soon as the police leave it starts up again. He has had enough. Late one evening he goes out and spreads oil all over the street. To try to prevent injury he place large signs at the entrance to the street warning that the surface is slippery and unsafe and low speed and caution are required to traverse it safely. Oscar reads the sign but chooses to ignore it and drag race on the street anyway, in direct violation of local law. The speed limit is 35 mph, but he reaches a speed of 120 mph before attempting to brake at the end of the street. Had he been obeying the speed limit he would have been able to stop. Instead he began a vicious long skid and crashed into a house at the end of the street. It was Adam's house, where a guest was staying for the weekend with her two children. The crash and subsequent explosion of the car's fuel tank set fire to the house. Adam was severely burned but managed to escape the fire. His houseguest was trapped with her children and began screaming for help. A passerby was able to enter the building twice and lead the houseguest and one of her children to safety with minor burns. On his third trip into the house to save the other child, the passerby was killed and the other child suffered serious burns with lifelong disfigurement. The passerby had ignored the direct instructions of police who were on the scene who told him not to go back into the house to save the children. All of the injured persons were transported at high speed to the hospital in several ambulances. One of the ambulances crashed into a retaining wall because of a defective brake in the ambulance, severely injuring its patient who had only suffered minor injuries in the fire. Another victim of the fire safely reached the hospital for treatment of the minor burns he had sustained, but was mistaken for another patient and thereafter had one of his kidneys removed as a result. Please discuss as clearly and succinctly as possible all of the legal issues raised by the above facts and circumstances.
