The child of the marriage, Dillon Lee, has always been in the care and control of Tina and it is proposed that the child remain in Tina's custody, care and control in the future. The said child has resided with the Tina since birth and since the separation of the parties. Tina's mother resides in the home with the Tina and her son and provides loving and appropriate child care for the period from 8:30 a.m. to 5:30 pm. daily while Tina is at work. Tina has made suitable accommodation and a loving environment for the said child and intends that the child will continue to attend schools close to her residence. Sammy believes that it is in the best interest of the child that he remains in the custody of the Tina. Sammy would like continued reasonable access to the child. However, Tina and Sammy disagree on what constitutes reasonable access. Sammy spends 2 afternoons a week with the child, but would like to increase that to 3 aernoons per week and 1 weekend (both Saturday and Sunday) per month. Tina and the Sammy have not come to an agreement regarding spousal support either. Sammy is paying $750.00 per month in child support, but feels that it is not necessary to pay any spousal support as he is paying more child support than the federal child support guidelines.
