Lily is a recent graduate from Unikl Mitec, Seri Alam, Johor. She has obtained an employment at a logistics company at PTP, Johor Bahru. Therefore, Lily decided to purchase a car to travel from her residence at Seri Alam to her new office and she proceed to make an appointment with the car dealer. Twinkle Car at Pasir Gudang. Lily was contacted by Twinkle Car dealer the subsequent week and they confirmed of her eligibility to make a 100% loan with Star Bright Bank Berhad. Lily went to the dealer and was approached by Ms Ong instead of Micheal Chang. Ms Ong informed Lily that the company had terminated Micheal Chang due to his unscrupulous behavior and Lily decided to report to Ms Ong of what had happen to her the previous week. Upon discussion with the management, the Twinkle Car dealer return the RM1000.00 to Lily as it is inconsistent with the Hire Purchase Act 1967. Lily proceed to executed the agreement with a Star Bright Bank Berhad on the same day and able to collect the car the following day. There is no problem with the payment for the first six (6) month of 2021, but due to the quarantine, Lily was retrenched from her job. Therefore she is unable to pay for the car installment. She continued to be in default for June and July 2021 which lead to the letter of demand for the two monthly payment. Lily is demotivated to ask Star Bright Bank Berhad for reduction of installment payment and decided to just keep quiet instead. Therefore, Star Bright Bank Berhad sent her a notice of repossession and due to the continuing default of another two (2) months they repossessed the car from Lily. When Lily discovered that the car is no longer at the car park, she was furious and contacted the Star Bright Bank Berhad saying she wants to sue them for unlawful repossession c (c) Analyse the rights and liabilities that Lily has in the event that there is a breach of Hire Purchase Agreement between her and Star Bright Bank Berhad.
