Issue Pending: Student Speech Contrary to popular belief, the Constitution's 1at Amendment does not grant unlimited protections for free speech - obscenity, libel, and threats are just some examples of speech that do not receive constitutional protection. Since the Constitution itself makes no such references to different types of speech, deciding what is and isn't protected falls to the nine justices of the United States Supreme Court. Last term, the Supreme Court heard Mahoney Area School District v. B.L. where the justices decided whether student speech that occurred off campus (but that used profane language directed at the school, its cheerleading team, and its coaches) should receive protection as free speech, or whether the school administration could punish such speech as a disruption of the school. Your job is to determine whether you believe the Court made the right decision. Specifically, you must address the following issues: . Do you agree with the Supreme Court's decision that B.L.'s Snap Chat post deserves constitutional protection under the 1st Amendment, or do you believe the school should hold the power to punish her for it? . Specifically outline how previous Court precedent aligns with the facts of this current case to form (and support) your conclusion. . What are the potential implications of your opinion? . Use the assigned readings to support your position and be prepared to discuss and debate your recommendation
