(1) the offender is a private individual;
(2) he kidnaps or detains another, or in any manner deprives the latter of his liberty;
(3) the act of detention or kidnapping is illegal; and
(4) in the commission of the offense, any of the following circumstances is present:
(a) the kidnapping or detention lasts for more than three days;
(b) it is committed by simulating public authority;
(c) any serious physical injuries are inflicted upon the person kidnapped or detained or threats to kill him are made; or
(d) the person kidnapped or detained is a minor, female, or a public official.

II. STATEMENT OF CONSENT
In the presence of witnesses, whose signatures appear below, my right against self-incrimination has been explained to me by the polygraph examiner of the PNP Crime Laboratory Service, he/she informed me that I have the right to remain silent that anything I say may be used against me; that I have the right to a lawyer of my own choice or have one appointed for me to be present while I am being questioned. He/she explained to me that this examination is being conducted in connection with the investigation of the stolen white Sony Vaio laptop which I am an alleged suspect. He/she further explained to me the nature of the polygraph examination and the fact that I cannot be required to submit a said examination without any consent.
Understanding my rights as stated above, I hereby voluntarily without duress, coercion, unlawful influence, inducement, promise or reward, clemency or immunity, submit to a polygraph examination with/without the assistance of counsel this 3rd day of August 2014.
