13:08 10H17EIEJE| Please answer the followlng questlon: Linda and John have been married for 11 years, They live in a house in Belfast which is is in Johns sole name, as he inherited the property from his grandmother. The couple have two children Kylie who is nine years old and Sam who is seven years old. Up until last year John worked for a large accountancy rm in the city centre, while Linda was the childrens primary carer. However, John then decided to realise his lifelong ambition and set up his own rm. However, setting up his own business proved to be more difcult than John had expected. He struggled to nd clients and three months ago he was forced to close the business down. John approached the accountancy rm for which he had previously worked and asked for his oldjob back, however he was told that the position had now been lled by a new employee. As John is now unemployed, Linda, who had not worked since Kylie was born, has got ajob as a classroom assistant in the primary school attended by Kylie and Sam. Linda is also still the childrens primary carer. Since becoming unemployed, John has become extremely depressed. After being accustomed to being the familys breadwinner, he nds being reliant on Lindas salary very difcult. He frequently shouts verbal abuse at Linda and has struck her on several occasions. While John is not violent towards Kylie and Sam, he has become withdrawn from them. The children have witnessed John being violent towards Linda, which they nd very upsetting. Linda does not wish to end the relationship with John and she does not want criminal proceedings to be taken against him. However she is frightened that Johns violence against her will escalate if she does not take steps to prevent this happening. Linda asks your advice about what she can do to protect herself. She also asks whether John can be forced to leave the house, at least for a while. Linda says that leaving the home is not an option for herself and the children. She explains that if they were to do so, the only place they could go would be her cousins house which is situated around 85 miles away in Strabane. Going to stay with her cousin would therefore mean having to uproot Kylie and Sam from their school where they are currently well settled, and Linda herself would have to leave her job as a classroom assistant. Linda also wishes to know whether she can obtain a legal order quickly if she needs to Advise Linda
