Please respond in IRAC format
You work for a food importer/distributor. Your shipping manager, Melissa, is passing along the text she just got from Brian, the new, crew lead hired at the pier warehouse. Here's what Brian wrote:
"We just received the 2 tons of basmati rice from Pakistan - now two weeks late. It was held up by US Customs for 10 days. The inspectors were doing something which I ran into in Port Los Angeles, last year. Customs sprayed part of the lot with some chemicals, testing for grain beetles or fungus, not sure. And when Customers released the LA shipment, they didn't bother to rope off the sprayed part. Maybe they think the spray is safe. But after we sold that lot in LA, we got flack from buyers. People who ate it were reporting virus-like symptoms. A few in restaurants ended up in the hospital, and one in a nursing home may have died.
So Customs was doing to the same spot testing on our Basmati last week. They won't tell us what they sprayed or where. Our customers are going to walk if we blow the delivery deadlines this week. We could cold water wash the two tons to fill the orders and get it out the door, whatever good that does. Or just let everyone know we're not shipping. None of this was our fault. Shouldn't be on us. What do you want me to do?"
You need to respond to this. You must either direct Melissa to ship before the deadline or cancel the orders. Please explain your answer in legal terms to help her and your boss understand your choice.
