Question 2 (10 points) (2 to 4 pages) Your supervising attorney assigned you a research project to answer to questions relating to her client, Alice Kim. On April 2, 2020, Alice Kim is a junior in the Cross Creek High School in Ohio. Dissatisfied with school's attendance policy, Alice and her friends started a demonstration at the school's gym and refused to attend class. The demonstration was peaceful until a group of students appeared to play a basketball and asked Alice and her students to move away. They started fracas and started throwing each other nearby chairs, mobs, and balls. School property was damaged. A school security intervened, but they physically attached the securities. The school principal ordered all the relevant students to leave, but Alice and her students refused to leave while the other students who intended to play a basketball left. The principal suspended Alice and her students for 7 days. No hearing was held after that. Under the Ohio Revised Code SS 3313.48, 3313.64, 3321.04, local authorities are directed to provide free education to all residents between six and 21 years of age and a compulsory attendance law required attendance for school year of not less than 32 weeks. Under $ 3313.66 of the Code, the principal of an Ohio public school to suspend a pupil for misconduct for up to 10 days or to expel her. In either case, he must notify the student's parents within 24 hours and state the reasons for his action. A pupil who is expelled, or his parents, may appeal the decision to the Board of Education and in connection therewith shall be permitted to be heard at the board meeting. Alice and her friends sued school officials seeking a declaration that the Ohio statute permitting such suspensions was unconstitutional and an order enjoining the officials to remove the references to the suspension from the students' records. 1.
