1. Eric has had his eye on Emma for quite some time. While she was bringing some groceries into her home, the defendant hit her over the head and put her into the trunk of his car. He drove ten miles out of town to sexually assault her. When he finally arrived at his secret location, he pulled her out of the car. Emma fought back. She grabbed a tire iron and smashed Eric over the head. Eric ran from Emma, but she chased him down and delivered a flying leg kick to the back of his head, subduing him until police arrived.

a. Propose preliminary criminal charges against Eric. Based upon the information you have, explain why you think Eric should be charged with those offenses.

2. Charles has spent the night partying like it's 1999 in at The Starboard in Dewey Beach. Because he has to work in Wilmington the next morning, he decides to make the drive from Dewey Beach to Wilmington at 3:00 AM going 90 mph. While driving to Wilmington, Charles receives a text from Mary about his plans for the weekend. Charles texts her back taking his attention off the road. His car strikes a church bus, killing all of the occupants.

a. Based on what caused the accident, what could Charles be charged with?

b. Would criminal liability change if Charles had not been speeding or using the cellular phone? Explain.

3. George thinks it would be funny to light a firecracker during a concert at a local theater. The theater is built to hold 150 people, but on this evening the theater has 200 people. He goes to the balcony, lights the firecracker, and drops it. When it explodes, some people become frightened and stampede the door. The carpet catches fire. Two people are trampled. Four people are burned to death. a. If George is charged with homicide, what type of homicide is he facing?

4. Kurt hates Hank. He decides to let him know how much he hates him. First, he begins by telling others that Hank has an STD. Then he starts sending Hank text messages that Criminal Law and Procedure Case Assessment read, "I'm going to kick your ass." Undeterred, Kurt pulls a gun on Hank outside of his classroom. As Kurt approaches, he shoots Hank. Luckily, Hank is quick and he dodges to bullet. The bullet bounces off the floor and strikes Tony. a. If Tony dies, what doctrine allows Kurt to be held responsible for his death? b. Would there be a different result if Hank threatened Kurt with a gun prior to the shooting? If so, what?

5. Scott decides to take Jean on a date. Her brother, Darwin disapproves. He decides to punk Scott to show his sister what a weakling he is. While they are returning from an evening walk in the gardens, the young lovers are besieged by Darwin, dressed as a masked swordsman who takes Scott's money and Jean's bracelet. But she is brave, and she attempts to stop the masked assailant. While in pursuit, she catches the assailant and stomps him to a pulp. Darwin recovers and retreats, but Jean follows him and slices his throat with a dagger. Darwin dies.

a. Does Jean have a defense if she is charged? If so, what? b. If Jean is not so brave, and she doesn't pursue Darwin but instead, Scott suffers an asthma attack from the shock of the robbery and succumbs. Can Darwin be held responsible for Scott's death? Under what theory?

6. One day while in an undercover vehicle, police observe a drug transaction. Ryan approaches Bob and has a brief conversation with him about cocaine. Bob directs Ryan to go see Betty. Ryan gives Betty money. Betty sends Ryan to talk to Al. Al gives Ryan a large zip lock bag of marijuana. The officers move in to arrest. Betty has 5 additional bags of marijuana on her, and another 10 matching bags are found in an empty coffee can next to her feet. a. Bob has been charged with distribution of a controlled dangerous substance in addition to possession of a controlled dangerous substance. He has retained your firm to defend him. You've been asked to come up with a defense theory for him. Explain the pros and cons of your theory.

7. Bessie is the treasurer of the Red Cross. She is responsible for managing the day to day financial matters of the organization. Bessie falls on hard times and she begins writing checks to pay her bills. Then she begins using the funds for other things, including paying for her ailing father's hospitalization. Her secretary Sheila meanwhile has decided to raid her boss's purse for $500 to buy some furniture. a. What charges are Bessie and Shelia facing? What makes them different? b. 8. Katherine and Meghan are homeless. They see a vacant house on 1776 Buckingham Lane. It's freezing and the house looks empty. They gain access via a slightly open window. They go in and rest by the fireplace. Suddenly, they are surprised by Ian who is armed with a gun. Kate and Meghan are eating his chocolate scones. He tells Kate, "Stop chewing, or I'll shoot." Kate keeps chewing and is shot. Meghan leaps forward and fights Ian causing serious physical injury. a. Based on the facts listed above, indicate possible criminal charges against each person, and explain why. Is there is a defense? Please indicate and explain.

9. Ted is walking to his home. It's quite cold out, so he's wearing a skull cap and a black pea coat. Charlie, president of the neighborhood watch, sees him walking through her neighborhood and becomes suspicious. She calls her brother Jaime, a local police officer, and informs him of what she sees. She tells him that the recent spate of thefts have her uncomfortable and that the man in the skull cap has never been seen in her neighborhood. Jaime tells her to calm down and assures her that he'll send a patrol car by to investigate. Charlie is impatient. Dressed in her cloak, she takes her 12-inch dagger with her as she investigates further. She surprises Ted at a clearing in her development and confronts him. Ted is frightened by this figure standing before him with the cloak and the blade. Charlie gets in Ted's face and yells at him. Ted responds by pushing Charlie away from him. Ted is later found dead with the blade in his chest. a. Should Charlie be charged? If so, with what? Explain your answer.

10. Johnnie and Jeff decide to burn down an empty house. They discuss the plans, purchase an accelerant and matches, and enter the premises. They spread the gasoline and light the fire. The house burns to the ground. When the fire marshal is attempting to determine the cause, she discovers human remains. Once it is determined that the person dies as a result of the fire, Johnnie and Jeff are charged. a. Please identify all possible charges Johnnie and Jeff face. Explain why you chose each one. Please also identify what, if any defenses are likely.
