Question No. 03: The constitutional petition was filed by Begum Nusrat Bhutto under Article 184 (3) against the Chief Martial Law administrator in order to challenge the validity of the chief of army staff (COAS) to promulgate martial law as well as the detention of Zulfiqar Ali Bhutto, who was arrested on Sep 17, 1977. Mrs Bhutto argued that the very intervention (by the COAS) amounts to an act of treason as stipulated in article 6 of the constitution of 1973. Please comment (even if critically) on whether or not: a) the entire framework under which the proceedings took place was free from any political influence & b) the decision made was justified on the basis of doctrine of necessity
