Presidential Decree 27 (PD 27) was issued by then President Ferdinand Marcos. It covers land primarily devoted to rice and corn production. The tenant farmer who tills the land is a beneficiary under PD 27 where a portion of the land he is tilling is awarded to him as an owner pursuant to and in accordance with the provisions of PD 27.

Mr. Recto owns ten (10) hectare farm lot planted with rubber trees. Mr. Recto allowed his caretaker (Mr. Calamba) to plant corn in between the trunks of the planted rubber trees.

One day, Mr. Calamba went to the offices of the Department of Agrarian Reform. He informed the personnel there that he is interested in availing of the benefits under PD 27. The DAR personnel went to the land of Mr. Recto immediately and found the land in question planted with corn. Several weeks later, the DAR issued a notice to Mr. Recto informing him that his land is planted with corn and is now subject of "operation land transfer" of the government under PD 27. Mr. Recto vehemently objected to the decision of the DAR. Decide this case. Explain.
