Prior to Chief Justice Earl Warren being appointed to lead the Supreme Court, the courts used what they defined as a "Hands-Off Approach" allowing for the Prison Administration and State Governments to operate their prisons with little court intervention. The idea was that by commmitting crimes, prisoners gave up some rights by the shear nature of being a convicted felon. However, with the Warren Court, prisoners soon obtained the right to access to the courts (Johnson v Avery 1969), rights in misconduct hearings (Wolff v McDonnell 1974), a right already in the 8th Ammendment was expanded to include prisoners "right to be free from cruel and unusual punishment" and "deliverate indifference" can be considered cruel and unusual (Estelle v Gamble 1976).
