Problem 3.a: Late Night with Cherry Garcia

At 2 a.m. in the morning, Gump Henson's girlfriend Darlene threatened to leave him unless he immediately procured a quart of Cherry Garcia ice cream. The compliant Henson got into his car and set off for the local Circle K store. On his way to the store, Henson decided to call Darlene on his cellular phone to confirm her order. Steering the car with his knees as he looked in the back seat for his phone, Henson soon lost control of his car, which jumped the curb and careened down the pedestrian sidewalk. Unfortunately, hapless Bismack Matumbo was at that very moment walking his dog, Boxer, along the sidewalk. As Henson's car zipped past him, the driver's side mirror nicked Bismack's arm, resulting in a painful bruise. Henson immediately stopped the car and began walking back to where Bismack sat stunned on the ground. Enraged at what Henson had done, Bismack turned to Boxer and said: "you know what to do boygo get 'em." The well-trained Boxer quickly leaped into action. Boxer, however, apparently needed glasses for he ran right by Henson and sank his teeth into the pant trouser of poor old man Kerbox, who just happened to be passing by the scene at that moment. Bismack later credibly testified that Boxer has never, and would never, bite a person. Rather, Boxer's training would always cause him to stop in front of the person he was ordered "to get" and snarl menacingly. Bismack genuinely, in his heart and mind, would never want to cause physical harm to another person.
