Professional's Liability

At its core, professional liability is a subset of negligence; however thedefendantis always aprofessional.As we know from our chapter on negligence,it requires four elements: Duty, Breach, Causation, Damages.It is often scary how often professionals make very simple, preventable errors in judgment. Doctors make the improper incisions, lawyers do not file lawsuits timely and are barred by the statute of limitations, accountants evenmake mistakes on filing taxes. Do you think there is any room for a "mistake" as a professional, or is it fair to say that anything less than perfect is malpractice? Does malpractice sway your opinion one way or another, as to whether professionals can be human, and make mistakes, or does their professional status require perfection in their particular field?
