PROBLEM 1 - Cal Code Section 1: Wills In order for a will to be valid, the will must be signed by the testator in the presence of two witnesses.

Facts: Mr. Beal signed his will while one witness, Ms. Smith, stood next to him, and the other witness, Ms. Byrd, was in the adjoining room getting her pen. Ms. Byrd was facing Mr. Beal and saw him bend over the paper at the time he signed.

PROBLEM 2 - Cal Civ Code Section 2: Solid Waste No garbage dump shall hereafter be established within the corporate limits of any city or town, nor shall any garbage dump be established within 250 yards of any residence without the consent of the owner of the residence.

Facts: The People's Garbage Dump was opened by the city in 1950. Three years later, Tom Smith built a house on a lot near the dump. The city acquired a tract adjoining the dump and within 200 yards of Smith's residence. The city plans to enlarge the dump with the new tract of land. Smith opposes the enlargement.

PROBLEM 3 - Cal Code Section 3: Distribution of Damages in Wrongful Death Action The injury in any wrongful death action may award such damages as may seem fair and may direct how the damages shall be distributed among the surviving spouse, the children, and the grandchildren of the decedent.

Facts: Martha Smith, for whose death a wrongful death action was brought, was survived by her husband, a natural born child of the marriage, an adopted, and her non-marital child.

PROBLEM 4 - Regulation 4(d). It shall be unlawful for any employee of the XYZ Agency to divulge confidential material in any file of the Agency.

Facts: Harry Franklin works for the XYZ Agency. In one of the Agency's personnel files is a notation that Paul Drake, another Agency employee, was once arrested for fraud. Harry obtains this information from this file and tells his wife about it. (She also knows Paul). Harry is unaware that Paul has told at least three other employees about his fraud arrest.

PROBLEM 5 - Regulation: 101. Car-pool lanes can be used only by cars in which there is at least one passenger in the car with the driver.

Facts: Alice Anderson is nine months pregnant. A police officer gives her the ticket because she was alone in the car at the time.
