Pru has a wonderfully successful start-up, Yentr. It is an online dating service that uses traditional "matchmakers" to match users through a series of interviews and questions. Pru hires Marley to help out. Marley is Pru's executive assistant and generally takes calls, manages appointments and organizes the business.

One day, Marley gets a call from a large dating app, Boomble. The person on the phone tells Marley that they are looking to purchase Yentr. They tell Marley that they will be sending over an offer and that they want a reply within one week. They want to announce a signed letter of intent before their next investor call.

Pru is off on vacation for one week and has given Marley express instructions that she is not to be bothered. Marley sends Pru the offer by email. Marley does not hear back from Pru for three days. During that time, Boomble calls Marley and asks if there are any updates. Marley says "Yes, Yentr is interested in your offer, we are just considering the details.". Boomble pressures Marley to give them some confidence that their offer is being seriously considered. Marley writes them an email back stating, "Yentr is seriously considering your offer."

Pru returns from vacation and confronts Marley when she sees the email chain. She states:

"Marley!? I am in talks with another purchaser and they have me under exclusivity! I am in breach of my terms since you talked to Boomble!"

Marley replies:

"Don't worry, it's not like anything I say has any weight. You're fine"

Discuss. Is Marley right? Why or why not.
