QL'ESTIDH 3 Pam was orphaned at birth. She is intellectually impaired and has an emotional age of only 8. In EDED, when she was aged 18, she suffered serious sexual abuse. whilst studying at a specialist residential college in Brisbane run by a religious order, the 'il'tngels of Mercy.' Her abuser, David, was a brother of the order at the time and an adviser at the college. He was not engaged under any formal contract, but was bound to the order by his vows. In return for his devotion and service, the order met all of his basic needs from the assets of a charitable trust. His responsibilities involved performing basic educational duties during the day and providing additional onetoone religious tuition to students on a flexible basis after hours, at his discretion. It was during these additional occasions of religious tuition that the abuse took place over a 5-month period. David's superiors in the order had performed police background checks on him before he was engaged at the college. These yielded no result and they had no personal knowledge that the abuse was taking place. There is no other evidence available concerning the precautions or procedures taken by the order to prevent abuse at the college during the relevant period. The abuse eventually came to light in January 2022, when Pam disclosed its details to her closest childhood friend, Louise. Louise is an empathetic personality and has struggled in the past with anxiety. She was so upset by the revelation that she has since fallen into a profound state of depression. She has had to give up her job and can no longer function normally. David has been imprisoned for his crimes.
