Alex clicked on the advertisement and was directed to SPORTS' online shop ("the Website"). When looking through the "SALE" section on the Website, Alex spots a Manchester United (hereinafter referred to as "United") Home 2019 (hereinafter "the United Jersey") being offered at $50.00 a piece but for self-collection only at SPORTS' retail store at Queensway Shopping Centre. Alex who is an avid United fan has been monitoring the prices of the United Jerseys and knows the current market price for that jersey is $100.00. Sniffing a good bargain, he added the United Jersey to the online shopping cart on the Website and clicked "BUY" with his finger. He was then directed to provide his email address and to make payment online and which he did so with his debit card. A few minutes later, he received an automated e-mail response from SPORTS (hereinafter "the Email"), confirming his purchase of the United Jersey. The Email also stated that the United Jersey was to be collected in seven days' time from SPORTS' retail store. On the day in question, Alex turned up at SPORTS' retail store and was informed by the management that they had run out of United Jerseys. Alex was offered the 2020 Liverpool Jersey as a replacement and without any need to top up the difference. The current retail price of the Liverpool Jersey is $130.00. The manager of SPORTS' retail store, Brutus, tried to reason with Alex and told Alex: "We are giving you a $130.00 jersey for $50.00 and some more this is a 2020 edition. What is your complaint, Bro? Alex was furious and demanded his money back. Brutus has refused to refund the money. For the purpose of this question, you are to assume the following facts: The prices quoted are correct and that there were no issues with the online purchase. Liverpool and United are two rival clubs in the English Premier League and their fans hate each other. It would be a real insult to a Liverpool fan to be given a United Jersey and vice versa. Indeed, it is not inconceivable for a United fan if given a Liverpool Jersey to use it as a cloth for cleaning the table and such feelings are mutual between the fans. Students are expected to analyse and discuss the facts, identify the issues and apply the law.

(c) Would your answer be different from (a) above, if Alex was offered the same model and size of the United Jersey that he had ordered online but asked to top up a further $10.00 due to inflation? (10 marks)

(d) What are the options available to Alex in respect of the situation at (c)? (10 marks)
