Question 1

Shaneez and Rowena both work in the state of Apelland asfruit pickers. Shaneez was born and

brought up in Apelland, and although she never visited Netherlands, she holds a Dutch

nationality, as does her father. Rowena moved to Apelland from Finland when she was six

months old. Although she holds no official nationality, Rowena considers herself an Apellander.

In 2000, Shaneez and Rowena established a haulage company under the terms of the Foreign

Investment Act 2000, which provides that adequate compensation is to be paid for any

expropriation, which may only be carried out for a public purpose.

Since the early 2000s the Orange Liberation movement (OLM), led by Prof Fruit, has waged a

revolutionary campaign in Apelland from the southern Mediterranean region, where Shaneez

and Rowena both live. During the campaign, Shaneez and Rowena's houses were destroyed and

the two are injured by the OLM fighters, contrary to specific orders by the commanding officer

present at the time. The OLM movement is successful in its campaign, coming to power in

2019. The first two laws passed are Proclamation 1, which provides for the expulsion of all non -

nationals living in Apelland and Proclamation 2, which permits OLM officials to take businesses

into part control where necessary to meet the party's needs. Compensation is to be paid at a

later date at a local rate.

In accordance with the proclamations, officials from Orange's Support Group, a non-official

group whose actions are regularly endorsed by Prof Fruit, apprehended and escorted Shaneez

and Rowena to the airport. Shaneez and Rowena were very upset that they have to leave all

their possessions and businesses behind for Netherlands.

Both Shaneez and Rowena have gotten to know that you handle international matters for

Netherlands. They come to you for advice:-

1. On their right to return to Apelland.

2. Their rights over their expropriated properties.

Advise Shaneez and Rowena.
