QUESTION 1
The Jones family (Bob, Tina, and Zoe) moved into a new house just before Christmas.
Bob decides to landscape the back garden. He notices a large wheelbarrow leaning against his neighbour's wall. Despite never having met his neighbour, Bob decides to borrow the wheelbarrow. When he finishes with it, Bob leaves the wheelbarrow on the pavement outside his house.
Bob then goes to the local garden centre where he has left his electric hedge trimmer for repair. He sees his hedge trimmer behind the counter. As there is no one around, he walks behind the counter, removes the trimmer and goes home without paying the repair bill.
Tina walks to the gate at the bottom of their garden, which leads into a large wood. She walks into the wood where she discovers several holly bushes growing wild. As it is Christmas time, Tina picks large bunches of holly to sell to colleagues at work.
The Jones's daughter, Zoe, goes shopping. She buys some earrings for 8 which she pays for with a 10 note, but the shop assistant accidentally gives her change from 20. Zoe spots some necklaces hanging from a stand on the jewellery counter and puts one in her pocket. Zoe notices the extra change once she is outside the shop but decides to keep it.
Discuss any offences contrary to section 1 of the Theft Act 1968 that any individual members of the Jones family may have committed
QUESTION 2
Mike and Kay are both members of Holloway karate club. During a training session, Kay hits Mike in the face with her forearm. Mike falls over, hitting his head on the floor as he lands, leading to concussion.
Mike's girlfriend, Gail, who has come to watch the session, sees what has happened and runs towards Kay, screaming that Kay will "be sorry for this". Kay grabs Gail and throws her to the ground. Gail suffers a cut to her arm that requires several stitches.
The following week, Kay sees Mike in the street, and waves at him, meaning to apologise. Thinking she is going to hit him, he hits her several times with his sports bag. This breaks some of her teeth and her jaw as he is carrying some weights in the bag.
Gail has depression and sleepless nights after the earlier incident and receives medication from her doctor.
Discuss the liability of Kay, Gail and Mike for non-fatal offences, including any defences any of them may have.
