Question 13 Annie, a former commerce student, is a model and aspiring actress. She is managed by her boyfriend, a part time photographer, Sven Gali. Sven is an intense, artistic type with ambitions of a career in the world of show business. She signed a management agreement with Sven in the belief that he knew best" and out of the fear that if she did not agree, he would break off their relationship. Annie has suffered heartbreak before and is afraid of the emotional cost of a breakup with Sven. She is also slightly wary of Sven who, when he gets angry is prone to irrational displays of emotion. In the past he has kicked her cat, Patches. Sven took a number of tasteful, but revealing, photographs of Annie. Annie has just starred in a remake of the classic film, "Little Women". Her portrayal of Jo as a feminist heroine has received critical acclaim and Annie is now in consideration for an Academy Award for her sensitive and moving portrayal of a woman caught between the pressures of modernity and the traditional feminine role." Sven wants to capitalise on the situation and to sell the photographs to Newsworld which is offering $250,000 for the photographs. Annie fears that publication of the pictures will damage her chances of success of an Academy Award. She is shocked to learn that the management agreement gives Sven the exclusive rights to any pictures taken of her by him and a complete discretion as to where those pictures might be published. Annie complains, "I would never have signed that management agreement if I had known that clause was there." Annie wants to end the management agreement with Sven and to recover the rights to the photographs. Advise her, detailing any potential causes of action she may have, what she would need to prove in order to avoid the contract, and assess her chances of success. 15 marks
