Prof. Zuma, a South African national has been a member of the academic staff of the University of Namibia for the past 15 years. He applied for a permanent residence permit a couple of months ago. Prof. Zuma has recently received a reply from the Immigration Selection Board (ISB) informing him that his application was not successful. He strongly feels that his application was refused purely on racial grounds. Prof. Zuma wants to institute legal action in the High Court for an order that his application should be reviewed. He approaches you, an attorney at Sue, Settle & Fight Inc. for advice.With reference to the appropriate Constitutional provisions and case law, write a legal opinion in which you advise Prof. Zuma of his rights. You must explain the circumstances under which the Court may review the decision of the Board and grant the order he is asking for.
