Question 3 You have been employed in the financial services sector for about five years now and took up your current post about 18 months ago. You were recently asked to qualify as a retail investment advisor, which requires you to take an exam and to be a 'fit and proper person'. Although you have succeeded in passing the exam, your criminal records check has unfortunately flagged up a criminal conviction for fraud (about 9 years ago) which you did not tell your new employer about at the time they hired you. You were called in to see the HR director this afternoon and were dismissed with immediate effect. You are now unemployed. Do you have any claim against your (former) employer? Give reasons for your answer.
