Question- An employee( in a federally funded organization) overhead a senior officer loudly tells others in the reception area what the employee's wage was and that his job performance did not measure up. The employee filed a complaint under PIPEDA for disclosure of his personal information without his consent. In response, the employer argued that the employee's consent for the disclosure was not necessary for two reasons. First, the wage rate disclosed was inaccurate(it was too high). Second, his salary was already publicly disclosed in the audited financial statements, which were available in the community library, and because he had not previously taken issue with the disclosure, he had already given his implied consent to its disclosure.
