FACT PATTERN FOR ALL ASSIGNMENTS AND COURSE OBJECTIVE ASSIGNMENTS

You are a paralegal at the Law Firm of Mike Smith and Associates. Your firm has an ongoing agreement for Legal Representation in South Florida for ALLFARM Insurance Company. In conjunction with this agreement a Claims representative contacted your firm today and hired your to represent them in this suit that they were served with Yesterday. They are being sued by Bonnie and Clyde Inc. Bonnie an Clyde Inc. is a Sub S. corporation with only two shareholders, Bonnie Shotgun, and Clyde Innocent, both of whom reside in Palm Beach County, FL. Bonnie and Clyde Inc. has insurance through ALLFARM.

The suit was filed in the 17 th Circuit of Florida, and has been assigned to Judge John D. Fry. Judge Fry is apparently a wiz at Civil Procedure and not known for tolerating Law Firms that don't know how the law works. According to the suit the following happened.

  1. In Palm Beach County, Bonnie and Clyde Inc. had an employee, Iam A. Thief, delivering a shipment of Laundry products. The Plaintiff alleges that a loose cow wondered into the road (St. Rd. 7) in Boynton Beach, Fl. The Plaintiff then slammed on their brakes but was unable to avoid hitting the poor hapless bovine. As a result of the accident the Plaintiffs vehicle, a 2018 Mercedes Carry-all was totaled, and Mr. Thief had to receive basic medical services.
  2. ALLFARM had a contract of insurance with Bonnie and Clyde coving PIP, Property, Bodily Injury, and Liability Insurance. ALLFARM conducted a preliminary investigation of the claim and believes it to be either fraudulent or grossly exaggerated. As such they paid only $35,000 of the $79,250.49 sought in the Suit.
