Last week, Dina placed an order for the purchase of 4 sets of porceline plates from E-Plates ('the company') which is an online shopping platform. One of the clauses by E-Plates states that 'All purchasers shall receive a confirmation of purchase through email'. Two days ago, Dina received an email from the company stating that it is unable to deliver the order requested as it is low in stock. Dina contacted E-Plates claiming the email is a confirmation of purchase from the company and its failure to deliver as according is to a breach of contract.
Meanwhile Dina has offered the sale of her limited edition handbag and handmade purse to Mary at RM700 and Sarah at RM 300 respectively on the 16/3. Dina informs them that the offer is to be accepted latest by the 21/3 before 12pm. Mary informs Dina that she is ready to purchase the handbag at RM500 but only to be notified that the price offered is final. On the 19/3, Dina decided not to sell the handmade purse and have emailed Sarah to inform her of the same. Sarah read the
email on the 20/3 and replied on the 21/3 at 9 am that she is accepting the offer. She insists that the the promise is already formed between them under contract law. On the other hand, Mary decided to accept the offer on the 21/3 at 3pm. She however did not receive a response from Dina. The next day, she was informed that bag was already sold to Jane at RM 900 on the 21/3 at 1pm. Mary is now claiming that Dina has breached the contract.
In a separate scenario, Dina had posted the follwing announcement on her social media platform
"2 year old cat named Brownie with light brown stripes is missing (Picture included). Please contact owner; Dina at 000123456 if found. A reward of RM 100 awaits for anyone who finds the missing cat"
Last Sunday, Jenny found Dina's pet cat. Dina however refuses to reward Jenny claiming that the announcement was not an offer in law.
