QUESTION Nomsa is a banking and finance graduate who has recently been employed by Ndalama Zambili Commercial Bank, as an assistant bank teller. Her job description is as follows: Receiving the working cash for the day and counting it before the shift begins; accepting deposits of both checks and cash and validating deposit slips; processing cash withdrawals; verifying customers' safe deposit property, admitting them to their safety deposit boxes and opening and closing vaults, receiving payments for bills, loans and mortgages, answering queries and assisting customers with account related issues; carrying out specialized tasks like foreign currency exchange, issuing of traveller's and cashier checks and money orders; balancing of the checks and cash at the end of every day Josh, who is Nomsa's immediate supervisor, is immediately smitten by Nomsa from the first day she reports for work. His subtle efforts to catch her attention and affections prove futile leaving him with no option but to hatch a plan to get her to spend more time in his office. One day, Josh commands a batch of 100 printing jobs and commands Nomsa to leave her teller counter during peak hour and pick up the papers from the printer and deliver them to his office. Nomsa refuses to attend to Josh's demands as she is busy attending to a long queue of clients. This infuriates Josh who then hatches another plan for the following day. The next day around 12:30 hours, Josh commands Nomsa to leave everything she attending to stretches out his hand with a K100.00 note and demands that she takes a cab to the nearest shopping mall to buy him his favourite lunch of chicken and chips with Coca-Cola. Nomsa walks away from Josh in disgust and retorts by stating: "Sorry, I am employed in this establishment as a banker and not your personal assistant, send someone else to do it. She then settles in the staff canteen to have her lunch and remains there until 14 hours after which she avoids Josh the entire afternoon Josh is infuriated by Nomsa's insubordination and intends to report her to the Human Resource Officer for appropriate disciplinary action. He has narrated all this to you, and seeks your approval of his next planned move. With the aid of appropriate legal authority, advise him on whether or not there any legal implications for Nomsa's behaviour [10 marks]
