Question Whilst studying at the Malaysian Institute of aviation Technology UniKL, Ali Bokhari from Gambia and Asmah Not you answered Ismet Ali from Malaysia met each other and were soon married in August 2010. Ali was then 17 years old and Asmah was 16. As the University did not provide accommodation for married students, All and Asmah rented a Marked out of 20 00 flat at Jenderam Hilir, about 4 km from the university, at a monthly rental of RM 300 from Burhanuddin Realty Ltd. Bhd and bought a rice cooker, refrigerator, washing machine, television and video player on hire purchase. They paid a down-payment of RM 300 and the balance to be paid by instolments at RM 150 per month for 36 months. Ali and Asmah were blessed with a happy married life In January 2011, they received a notice to quit from Burhanuddin Realty Lid for non- payment of rent for the past two months and Sunny Electrical Son Bhd gave notice to repossesse the electrical goods for arrears of instalment payments since October 2010. Asmah then approached her student adviser, Encik Ishak, for advice. Encik Ishak a kind-hearted soul, who was ever ready to help his students, gave Asmah a loan of RM 1000 and Asmah signed a promissory note agreeing to repay the said sum. She used the RM 1000 to pay for the arrears in rent and instalment payments. However, in March 2011, they were again in arrears of rent and instalment payments and Burhanuddin Realtty Lid and Sunny Electrical Son Bhd threatened legal action, Encik Ishak met Asmah requesting for the loan of RM 1000. Asmah told Encik Ishak on the financial problem faced and again asked for the advice. She also told Encik Ishak that her late father had left with some plot of land ot Damansara Height to her. Encik ishok advised her to sell her land to settle the debts and he offered to buy it himself ot RM 100,000 without disclosing to Asmah that it was worth at least four times that amount becouse of mineral under the land. He however told Asmah to seek legal advice from a lawyer on his offer. Asmah trusting Encik Ishak, did not seek any advice and did not inform her husband, sold the said land to Encik Ishak for RM 100,000. A week later, Asmah discovered the truth about the contract of sale and wants to set aside the contract. Faced with these problems Ali and Asmah approached you asking for legal advice.
