Since commencing work as an apprentice mechanic, he has saved his earnings and purchased second hand luxury cars, which he then modifies cosmetically as a hobby. Most recently due to the ongoing impacts of covid19, Sam's employer of 20 years, Prestige Motors Co, has issued redundancies, with Sam being one of the employees being affected. This news is devasting to Sam, who holds a mortgage and has a family to support. With the current concerns of inflation, Sam has decided to let go of one of his BMWs, to create some financial flexibility whilst he searches for a new job. On 31 July 2022, after dinner, Sam posts an advertisement on Facebook 'Car Lovers Forum' advertising the sale of his beloved 2015 BMW 3 series coupe. His post reads as follows: URGENT SALE 2015 BMW 3 Series Coupe, Limited Sports Edition, repainted in Gun Metal Gray with a golden tint and reupholstered cream colour leather seats! Truly one of a kind! This beauty has only clocked 99,000km. All reasonable offers above $30,000 will be considered. For more information or to make an offer, please contact Sam Jones on 0400 125 125 or samjones@jones.com.au Alex, also a car enthusiast, sees the post on the same night it is listed and calls Sam on Monday 1 August at 10am. Alex is unable to get hold of Sam, so he leaves a voicemail. 'Hi Sam - super keen on this one, mate. I'll just need to get my finances in order - so if you could hold this for me until Friday, I can make you a formal offer then. Thanks." Leo, a 18 year old who has just received his driver's licence, also comes across the post. He has almost enough savings for the car. He sends an email to Sam on Tuesday 2 August, stating the following: "I am writing in response to the advertisement to purchase your BMW. I confirm that I will pay $28,000 in exchange for the car."Also on Tuesday, Peter. who is Sam's high school friend, speaks with Sam. He expresses an interest in the car and offers $30,000. Sam states that he will sell his BMW to Peter. At least his long term friend will take good care of the car. They plan to undertake the exchange on Friday. On Thursday morning Alex calls Sam again. 'Hey dude, lire got the $30,000 ready to go now. When can we meet for the exchange?' Sam explains to Alex that the car is no longer available. Alex is disappointed. He had his eye on this model. "Look, l am a serious buyer, Sam. l wlll offer you $33,000 for your BMW: And will collect ll tonight from you. \" This offer is too good to reject, as Sam could do with the extra cash. Sam tells Alex. 'lt's all yours.' Sam then calls Peter after the exchange is nalised with Alex. He explains he received a better offer, so the car is no longer available. Peter does not take this news well. 'Mate we had an agreement! lts enforceable! You're obliged to sell it to me!
