Rainbow Bright manufactured a playscape and sold it to Home Depot. Rainbow Bright disclaimed all warranties. Home Depot sold the playscape to the Smith family for their children to play. Home Depot expressly warranted that the structure would last for 50 years (assume there is no issue with home assembly). A few weeks after buying the playscape, the Smith kids were playing and their parents were watching them swing the structure broke, causing the playscape to crumble and crushed the family dog, who broke his leg and needed to go to the emergency vet. Further, the daughter broke her arm and the son suffered a concussion. Not only did the playscape not satisfy the warranties made by Home Depot, but the playscape was also defective and unreasonably dangerous in its manufacture.
