Two of the accused's co-conspirators were alleged to be Ben and Smith who were members of the Polish secret police. The evidence showed that in July 2020, Ben had transmitted to Smith written information regarding Raymond which Ben had received from Warsaw. The information was on "hard film". Smith had made a "soft" film of it and had hidden it in his home in Ukraine. The film was recovered by agents of the police of Ukraine and a copy of the film was offered, over objection, and received at Raymond's trial. The message on the film, which implicated Raymond, was read in court. Counsel for the accused objected to the receipt of the message on grounds of hearsay.
