"I do not believe plea bargaining should be used as a tool to mitigate prudent justice administration, and therefore, disagree with Justice Kennedy. Furthermore, I define prudent justice administration as the way the criminal justice system was meant to be used as a way to deter criminals and/or seek justice due to the actions thereof. The reason that we have laws that state the recommended punishment dependent on the crime is because we, the citizenry, have concluded that certain crimes are indeed worse than others. As such, to lessen the severity of said punishment through plea bargaining is just an attempt to thwart society's bidding. With this said, I know that such a stance has its detractors.

For starters, one may argue that plea bargaining circumvents the issue of severe punishments served to offenders of minor infractions. I would tend to agree that that is an issue in our judicial system. However, I do not believe plea bargaining is the answer, rather the solution should be sentencing reformation. Another argument bifurcating from the idea of lighter sentence terms is that there is no evidence that longer sentences deter crime. This viewpoint is shared with The Vera Institute of Justice (2023). While the research does show that longer sentencing does not reduce crimes when recidivism is used as the guiding metric, I would argue that the probability of an imprisoned offender recommitting a crime outside prison walls is slim to zero."
