The State of Maryland's legislature has passed the "Animal Product Labeling Act" ("APLA") and the Governor has signed the APLA into law. The APLA requires that any and all food products sold within the State of Maryland that contain all or any part of an animal (i.e., chickens, cows, and/or any other animal) must have a label on the product that clearly states (i) the type of animal in the food product (i.e., whether it is parts of a chicken, a cow, etc.), (ii) the specific part of that animal that is in the food product, (iii) the State and City where the animal was processed (i.e., slaughtered), and (iv) how the animal was slaughtered and killed for processing.
The Maryland legislature also included a provision in the APLA so that the APLA only applies to food products being imported into the State of Maryland and it does not apply to food products that are manufactured, processed and created solely within the State of Maryland and either sold within the State of Maryland or exported out of the State of Maryland. The label on food product must be clear and readable and have a font size of at least 12 font (so that everyone can read it and its not hidden as "fine print").
The Pambell Soup Company is a large corporation that manufactures and sells canned soup throughout the United States. Its sales of canned soup exceed 2 billion dollars. It manufactures its soup in the State of New Jersey and then imports its canned soup into the State of Maryland and other States. The Pambell Soup Company is obviously concerned about the APLA because it will increase the costs of its canned soup. Mainly,it will have to create a new label to put on the cans of soup and it will need special labels just for its canned soup imported and sold in the State of Maryland.
The Pambell Soup Company has filed suit in Federal Court, claiming that the APLA violates the US Constitution because the United States Congress has the right to regulate interstate commerce under the Commerce Clause of the US Constitution. In response, the State of Maryland states that the APLA is constitutional because Congress has not enacted any laws regarding the labeling requirements covered by the APLA and the State of Maryland has the right to regulate such matters under its reserved "police powers." The Pambell Soup Company disputes these claims and has noted that not only will the APLA cost it thousand of dollars in extra labeling costs, it will affect all other food producers that produce food products outside of the State of Maryland and import them into Maryland, and thus the APLA will have a significant impact on hundreds of businesses. In fact, the Pambell Soup Company has stated that if the APLA is upheld as being constitutional, it will stop selling soup in Maryland, and this will require it to lay off about 1,000 workers in its New Jersey manufacturing plant because of the loss of sales.
