She seriously doubted at his age he could afford a car like that, let alone the required insurance coverage. Officer Carr radios you, since you are her supervisor, and asks whether she should pull him over to verify he is indeed the owner of the vehicle and that it is properly insured. What do you tell Officer Carr and why?
B. Later, Officer Carr observed a woman riding a motorcycle roll through a stop sign. She pulled the woman over and instructed her to get off the bike to stand at the edge of the road. The woman had a spider tattooed on her neck, which made Officer Carr nervous, so she demanded the woman take off her hat, coat, boots, and gloves. Officer Carr then searched through those items and patted the woman down for dangerous weapons. The woman's license, registration, and insurance all checked out. Officer Carr issued the woman a citation and allowed her to leave. What do you say to Officer Carr after you review her report on this stop, search, and frisk and why?
C. Near the end of her shift, Officer Carr noticed an elderly couple in an Oldsmobile. At the stoplight, the gentleman tugged on his earlobes, while the lady patted the top of her head with her hands. They did so continuously for the duration of the red light. When the light turned green, they ceased the behavior and the driver proceeded on. However, at each of the next three stop lights, they both resumed their tugging and patting. Officer Carr thought, "better safe than sorry", and pulled the vehicle over. When she asked about their behavior at the stop lights, they both indicated it was just a funny little habit they acquired many years ago to amuse their young children, convincing them it made the light turn green faster. The lady, who was an avid fan of cop shows, asked Officer Carr whether she should read them their rights since they had been pulled over. Officer Carr declined to answer and told them they were free to go. Officer Carr puzzled all night over this stop and came into your office the next morning to discuss it. She wanted to know whether the stop was appropriate and whether they had been entitled to a Miranda warning. What did you tell her and why?
