Read the fact pattern below and discuss what parties (look for 3 defendants) thatmay be guilty of NEGLIGENCE, making sure you discuss all 4 elements!!!

Facts:

Susie Sorority was riding her bicycle across the USF Tampa campus. At the same time, Freddie Fratrat was in his dorm room, playing drinking games with his fraternity brothers. He had been through 12 beers and 12 shots of tequila. He stepped out of his dorm, smoked some crack and meth, and proceeded to paint himself in dayglow green and gold in honor of the bulls.

As the meth and crack kicked in, Freddie got so amped up he sprinted across campus naked, painted dayglow green and gold for USF, screaming "I'm Henry the 8th I am... Henry the 8th I am I am..." at the top of his lungs and blowing hard on a whistle that hung around his neck in between choruses.

Susie saw this lunatic sprinting towards her, got nervous, swerved on her bike, and hit a US Postal Service mailbox that was next to the bike path she was on. As Susie lay there crying, Freddie moonwalked over to her, pinched her cheek, and ran off laughing out loud. He was found later passed out on a bench behind the library by his frat brothers, who got him back to the dorm. Susie suffered a broken ankle from her fall.
