Read the following scenario. In paragraph format, discuss and explain whether the agreements are unenforceable under all of the following reasons: to fraud, misrepresentation duress and undue influence.

Charlie Sue Manler was seriously injured in a car accident. Manler was substantially compensated for her personal injuries. Part of her compensation included funds for future medical care. Bree Green agreed to care for Manler. Manler provided Green with a room, office, computer, food, medical insurance, cell phone and car. Bree did not receive a salary or any other payments. For the next several years things worked fine and Bree became more involved with caring for the entire Manler family, including caring for the children, handling the family finances and made sure the household ran smoothly. Manler agreed to care for Green for the rest of Green's life and to include Green in her will. In 2022, Green went on vacation and returned with her niece. Manler was relunctant to have the niece in the home, however Green was adament that the niece had no where to go. Because of Manler's hesitancy, Green became concerned with her future with Manler. To appease Green, Manler set up an investment account of $450,000 in both of their names. Green would receive half of the income from the investment account. Green also drafted a contract with the following provision:

WHEREAS, MANLER desires to express in writing her agreement to pay GREEN a minimum of $450,000.00 immediatly for the work GREEN will do for MANLER for two years. Now with this payment all previous agreements and wills are null and void between two parties. GREEN is willing to provide services beyond two years if acceptable working condition is provided.

The relationship between Manler and Green continued to deteriorate and Green moved out. Manler placed a hold on the investment account and when the hold was released, Green withdrew all of the funds. Manler sued Green alleging that the agreements were unenforceable.
