Read the passage concerning US Army Sergeant Timothy Hennis. Under the US Constitution, the Fifth Amendment prohibits the same sovereign entity from trying a defendant for the same crime twice. However, it does not prohibit another sovereign entity for charging the defendant. What do you think? Should a State be allowed to charge and convict a defendant for the same crime they were found not guilty of in another State or Federal Court? Why or why not?
