Redone Techno Ltd, a shipper of machine parts, delivers two bills of lading to Maxxis plc., the buyers, and retains one of the bills of lading. Bill of lading states that the goods can be collected by Maxxis plc. and whoever they assign it to. On 1 August 2020, the buyers refused to accept the bills of lading and demanded that all three bills of lading must be presented to them. Furthermore, upon inspection it was discovered that the bills of lading had been issued in London and Hull where the goods were initially loaded. However, the goods had arrived safely at Port of Klang on 18 August 2020. Maxxis plc. managed to take the goods at Port of Klang after convincing the shipmaster with a letter of indemnity from Public Bank, to the effect that the bank would be prepared to indemnify the shipmaster for any potential liability.
