Texas in 1970s had the an established criminal abortion law, where the only way to have an abortion if it was to save the mothers life. McCorvey sought counsel from Jane Roe, who challenged the constitutionality of the law. In turn, the Roe v. Wade was decided in 1973, stating that the person may proceed with an abortion up until the fetus is viable. "Viability means the ability to live outside the womb, which usually happens between 24 and 28 weeks after conception." This law was covered by the due process clause of the fourteenth amendment for right to privacy.
