RESPOND TO THIS POST IN (one hundred fifty) WORDS OR MORE Litigation is one of the several legal terms that so many people always claim to know what it means but never really know what it is. The REAL definition of litigation is "Litigation refers to the process of resolving disputes by filing or answering a complaint (Links to an external site.) through the public court system. "(Cornell) Courts typically use litigation as the starting point when it comes to a Trial, and it more often than not comes from the side of the defendant. It will often concern which rights were being taken from them in the moment and what rights were never acknowledged. As for which case I decided to use I decide to utilize a case of Hearst versus Florida it concerned a former Popeyes employee convicted of murdering a coworker. Now I chose this because I use to work at chipotle and there were several instances where you may want to kill your co- worker but in this case, the felon in question acted on this impulse. "The Court held that the Sixth Amendment requires a jury, not a judge, to find each element necessary to impose the death sentence. Although the Florida sentencing scheme required that the jury recommend a death sentence in order to impose the death penalty, the judge was only required to take the jury recommendation under consideration." ( ) Just consider this, even though the jury would have found him guilty and would have suggested the death penalty, it would be only considered an advisement and not something that should be followed.
