Roseanne founded a company called Millennial Tours, which specializes in travel tour groups for millennials ranging in ages 21 to 30. Millennial Tours has been doing business with Randy of Randy's Promotions for over 8 years.Initially Roseanne was quite happy with the relationship and found Randy's service (in both print and digital media) to be excellent. Over the past year and a half, however, Randy's Promotions has consistently failed to meet deadlines set by Roseanne. Roseanne has spoken directly to Randy about this, and while the problem was solved for a short time, it has recently begun to be a problem again. On the other hand, Randy's prices are the lowest that Roseanne has managed to find.
Randy also has some issues with the business relationship with Roseanne. At the outset, Millennial Tours always paid bills on time. However, over the past two years, Millennial Tours is regularly missing the due date for payment of invoices. Randy has employees to pay and has to pay his suppliers. Randy's suppliers are not pleased when Randy has not been able to pay in full due to shortfalls in payment by Roseanne!
Roseanne ordered a new multi-media advertisement to appear on her social media and web pages. It was her plan to premiere this advertisement at a tourism trade show. Unfortunately, Randy's web design team was not able to get this job done on time and Roseanne had to rely on a previous multi-media advertisement. Millennial Tours was hoping to win an exclusive contract with Grand Hotels. Past discussions were promising but after seeing the presentation, a representative of Grand Hotels commented that this presentation seemed "old" and "stuffy". Ultimately Grand Hotels selected another tour company for this exclusive contract. When she called to complain to Randy, he told her that he was still waiting for payment from the last invoice, which was overdue, and was not at all sympathetic.
In light of the foregoing, and assuming that direct discussions between the parties has not been successful, answer the following questions:
a. List, and briefly explain, the dispute resolution mechanisms available to Randy and Roseanne and provide two advantages and disadvantages for each (please explain your answers thoroughly, with direct reference to the above-scenario and you may set it up in chart form). (24 marks)
b. If you were advising Roseanne as to how to proceed, which one of the available mechanisms would you suggest she select and why, and which ones would you reject and why? (6 marks)
